A MAN choked his 64-year-old mum in her own home.
Stephen McNulty, who lives with his parents, was drinking in their house in Carntyne when the assault took place on November 20, 2020.
At Glasgow Sheriff Court, fiscal depute Danielle McGuinness said: “The accused’s behaviour became increasingly aggressive towards his parents.
“At 10pm he began to shout and swear at his father. His mother intervened and he stated, ‘what you doing, ya cow’. He grabbed her by the throat and for a short period of time choked her.”
McNulty’s father removed the 34-year-old from his wife, and she fled her home to contact police.
His father remained within the house, however, McNulty continued to act aggressively, resulting in his father also leaving, to wait until police arrived.
When cops attended, his parents made themselves known and told police McNulty was extremely aggressive and should approach with caution.
Other officers were then requested to attend, and McNulty was found within the living room intoxicated.
Ms McGuinness added: “He was arrested and when being led out, shouted ‘f**k yous’ at his mother and father. He was thereafter taken into police custody, cautioned, and charged and made no reply”
The court heard that McNulty has an alcohol and Valium addiction.
His lawyer said: “He advised me he had been drinking in the days prior to the offence and was drinking to excess.
“He has little recollection of the offences due to his addiction but was able to recall that there were discussions relating to his childhood and he said his parents were calling him a liar. That escalated and he began arguing with his father.
“He advises me he has no memory of the assault. I have spoken to his mother, and she told me that she called the police because she wanted him out of the house to calm down.
“He was later returned to the house by police that same night. He’s still staying at his parent’s house. He has a fairly limited record and has various problems with his physical and mental health.”
Sheriff Valerie Mays told McNulty: “It’s a serious offence to seize someone by the throat. I have limited options here given what’s in the report.
“I’ll make you subject to a structured deferred sentence. You need to be aware that it’s a serious offence. It’s one that could lead to a custodial sentence being imposed.
“You have to comply with the structured deferred sentence. If you don’t, I’ll need to decide what I want to do. I know you have got difficulties, but this will give you the support you need to try to deal with them if you choose to do so.”
