TWO men were caught on CCTV attacking another man in Glasgow city centre.

Louis Smart, 23, of Cumbernauld, and David Russell, 23, of Moodiesburn, were sentenced at Glasgow Sheriff Court after pleading guilty to assaulting Kevin McGinley.

The court heard that Smart and Russell were seen on camera by CCTV operators attacking McGinley, who was a stranger to the duo, on Sauchiehall Street at around 3.30am on February 13, 2023.

Smart could be seen to kick McGinley to the head one time meanwhile, Russell punched him on the head.

Police were alerted to this and responded to the area where both Smart and Russell were traced and arrested.

The procurator fiscal depute explained that the incident had been over very quickly.

Addressing Smart’s lawyer, Sheriff Patricia Pryce said: “It’s slightly concerning as he has a previous conviction for assault to severe injury in 2018."

The defence solicitor replied: “Mr Smart’s only involvement was a single kick when the complainer was on the ground.

“He should not have done it and has not attempted to minimise it. The previous conviction was from when Mr Smart was 16, his life is completely different.”

Russell, representing himself, said: “I’m holding my hands up, I committed the crime. I’m very ashamed of my actions.”

Addressing Russell, Sheriff Pryce stated: “It is a very serious charge. It’s clear to me you take full responsibility for your actions.

“This is your first time in court and I would hope your last.”

Sheriff Pryce placed Smart on a community payback order with 144 hours of unpaid work.

Russell was also placed on a community payback order with 135 hours of unpaid work.
