A DOCTOR allegedly carried out a sex attack on a patient after telling her she was pregnant.

David Baillie, 70, allegedly touched the woman at a health centre in North Glasgow. 

The woman told a jury that Baillie internally examined her in 1999 during an emergency appointment where she had been told she was expecting twins.

The witness stated that Baillie did not explain what he was going to do nor offer the services of a chaperone.

Baillie, of Coatbridge, is charged with two charges of indecent assault on the woman between 1994 and 1999.

Glasgow Sheriff Court heard on Tuesday from the now 51-year-old home support worker.

She stated that she made an emergency appointment as she was feeling ill for three weeks.

The woman claimed that Baillie was in the room at the surgery with a nurse who took her urine sample.

Prosecutor Mark Allan asked if Baillie provided an explanation of the results of the test.

She replied: “He said I was pregnant, and I had a kidney and urine infection.”

The woman claimed that the nurse then left the room for an unknown reason.

She said: “He told me that he would have to do an internal examination to make sure my pregnancy was okay and I wasn’t going to have a miscarriage. I was pregnant with twins.”

Mr Allan asked if Baillie offered the services of a chaperone for the examination.

The woman replied: “No.”

She stated that Baillie conducted the examination which lasted around 10 minutes.

Mr Allan asked the witness if Baillie explained what he would be doing.

She stated: “No.”

The woman claimed that Baillie was “not very nice” after the examination and “unpleasant".

She stated: “I thought that’s what happened and that’s what he was supposed to do, I didn’t think anything.”

The woman earlier told jurors that she visited Baillie after finding a lump on her breast in 1994.

She stated that she was asked by Baillie to take her top off and to lay on the bed.

The woman claimed that Baillie went on to conduct a “thorough examination” on her breasts to make sure there were no other lumps.

She added: “He asked me to sit up on the medical bed and he went behind me and took my bra off.

“He unclipped it.”

Mr Allan asked if he said anything before doing it and the woman replied: “No.”

The fiscal depute then inquired with the witness how she felt about it.

She stated: “I was totally taken aback, I just thought it was inappropriate. I was at the doctors for previous lumps and they didn’t do anything like that.”

The woman stated that Baillie then instructed her to move and lift up her arms.

She said: “He was staring at me.

“He was looking to see if things were sticking out or disfigured, he was just standing there telling me what to do.”

The woman also stated that she was not offered a chaperone for the examination.

Desmond Cheyne, defending, put it to the witness that the only time Baillie touched her breasts was when she had her bra on.

She replied: “Yes.”

Mr Cheyne also asked if he gave an explanation as to why he was looking at her.

The woman again stated: “Yes.”

Mr Cheyne further inquired if the woman found anything about the examination, after finding out she was pregnant, medically unjustified.

She replied: “No, he was saying he was trying to make sure my pregnancy was alright and the baby was okay.”

Mr Cheyne asked the witness what part of the two examinations did she feel and felt was inappropriate or unacceptable conduct.

She said: “I wasn’t completely sure about the internal examination, I don’t know if that’s what he should have done to make sure the pregnancy was okay but removing the bra is really inappropriate.”

The trial continues tomorrow before sheriff Shona Gilroy.
