A man was sent to jail after he was caught driving while disqualified.

Police got a call on February 29, 2024, that a man was drinking beer from a bottle while driving on the M77.

Cops responded and found Allan Muir's car parked against the curb on Helen Street.

The 46-year-old was in the driver's seat. He said he was looking for a building and going for an interview.

When he gave his details, it was revealed that he was disqualified from driving.

Muir, of Kilmarnock, was removed from the vehicle and officers carried out a search.

He was arrested, cautioned, charged and taken to Govan police station.

There, he was asked to provide a breath sample. He said: “I don’t agree to it, had a heavy session last night, I don’t want to incriminate myself further.”

It was revealed that he was disqualified for six years in 2020 at Kilmarnock Sheriff Court.

Muir appeared at Glasgow Sheriff Court last week after he pleaded guilty to driving while disqualified and failing to provide a breath sample.

At the hearing, his lawyer said: "His car was seized. He has spent 21 days in remand."

Sheriff Vincent Lunny observed: "This is the sixth road traffic matter but the fourth that involved drinking."

The lawyer responded: "He did engage with social work and he completed his unpaid work.

"This is his first period on remand in Barlinnie. He engaged with the detox programme.

"He has been able to have long periods of reflection on the potential effects his behaviour had. He knows this affects his children.

"He accepts what the court gives him.

"He has positive employment prospects as a project manager.

"It will not involve driving. There is no excuse for his poor decision-making."

The sheriff repeated that Muir told cops he was on his way to an interview and had been drinking the night before. He added: "That is not a good way to prepare."

The lawyer stated: "He is extremely embarrassed. These offences are very serious, he knows that."

Sheriff Lunny said: "This is a pattern."

Muir's solicitor explained: "He bought the car to allow him to be driven by his friend."

The sheriff said: "He has got to realise he will end up in jail if he keeps drink driving. 

"He has to address alcohol has been a major factor and he accepts that he needs help with that."

He addressed Muir: "You are fortunate that no one was hurt. Your driving record is one of the worst I have ever seen.

"I am thinking of disqualifying you for life, however, I think that you will drive again regardless. And that would put the public in danger."

He was jailed for six months and disqualified from driving for eight years.
