A car sales firm has been hit with an Enforcement Order after complaints about unroadworthy vehicles being sold.

Cumbernauld Car Sales Ltd, and its sole director Jakub Niemczyk, have been served the court order banning it from engaging in a number of unlawful practices.

North Lanarkshire Council Trading Standards took the matter to court after it received “a significant number” of complaints from customers regarding cars sold by the company.

The lengthy list of complaints included: the sale of unroadworthy vehicles, misleading statements in respect of vehicles, and refusal to provide consumers with their statutory right to redress when vehicle faults were identified.

The order against the company was granted at Airdrie Sheriff Court and covers a number of practices.

The Enforcement Order commits the firm and Mr. Niemczyk to a number of conditions when selling cars.

They must provide consumers with written notice of their right to cancel any contract at the time it is made, where applicable.

They must ensure that all vehicles sold are not dangerous.

They must take reasonable skill and care when preparing second-hand vehicles for sale.

They must not provide false information to consumers or create the impression that a motor vehicle can legally be sold when it cannot.

“However, we will not hesitate to take firm action against businesses that persistently and unlawfully treat consumers badly.

“This enforcement action underscores our commitment to ensuring consumer rights are protected and that businesses operate within the bounds of the law.”
